Kısaca: SmartPlate, günlük öğün kararlarınızı kolaylaştırmak için tasarlanmış
bir eğitim ve alışkanlık aracıdır. Tıbbi cihaz değildir, teşhis koymaz,
tedavi önermez ve hekiminizin yerine geçmez.
1. Bu şartların kapsamı
Bu şartlar, SmartPlate mobil uygulamasını ve oasisofbalance.com
üzerindeki sayfaları kullanımınızı düzenler. Uygulamayı kurarak veya kullanarak bu şartları
kabul etmiş olursunuz. Kabul etmiyorsanız uygulamayı kullanmayın ve cihazınızdan kaldırın.

2. Uygulama ne yapar
- Girdiğiniz bilgilere göre öğünlerinizi kurmanız için genel bir çerçeve önerir.
- Öğün, su ve günlük kayıtlarınızı tutmanızı sağlar.
- Kayıtlarınızdaki haftalık ve aylık örüntüleri size geri gösterir.
- Kalori saymaya dayanmaz; porsiyon ve bileşim kararlarına odaklanır.
3. Uygulama ne yapmaz — önemli sağlık uyarısı
SmartPlate tıbbi cihaz değildir. Hiçbir hastalığı teşhis etmez,
tedavi etmez, izlemez veya önlemez. Uygulamadaki hiçbir içerik tıbbi tavsiye,
teşhis veya tedavi niteliğinde değildir.
Uygulamadaki bilgiler genel niteliktedir ve genel yetişkin nüfusu esas alır.
Kişisel durumunuza uygun olup olmadığını yalnızca sizi muayene eden bir sağlık profesyoneli
değerlendirebilir.
Uygulamayı kullanmadan önce bir sağlık profesyoneline danışmanız özellikle gereken durumlar:
- Gebelik ve emzirme dönemi
- Diyabet, böbrek, karaciğer veya kalp hastalığı
- Yeme bozukluğu öyküsü
- Beslenme ile etkileşen ilaç kullanımı (insülin, oral antidiyabetik, antikoagülan, tiroid ilaçları dâhil)
- 18 yaş altı olmak
Sağlığınızla ilgili acil bir durumda uygulamayı kullanmayın; bulunduğunuz ülkenin
acil servisini arayın (İspanya ve AB genelinde 112).
4. Kimler kullanabilir
Uygulama 16 yaş ve üzeri kişilere yöneliktir. 18 yaşın altındaysanız
yalnızca bir ebeveyn veya vasinin bilgisi ve onayı ile kullanmalısınız.
5. Hesap ve verileriniz
- Uygulama hesap açmadan çalışır; ad, e-posta veya telefon istemez.
- Sağlıkla ilgili tüm verileriniz yalnızca cihazınızda saklanır. Bulut yedeklememiz yoktur; bu verileri göremeyiz.
- Bu nedenle uygulamayı silerseniz, telefonunuzu değiştirirseniz veya cihazınızı kaybederseniz kayıtlarınızın geri getirilmesi mümkün değildir.
- Cihazınıza ve uygulamanın kurulu olduğu hesaba erişimin güvenliği sizin sorumluluğunuzdadır.

6. Kabul edilmeyen kullanım
- Uygulamayı tersine mühendislikle çözmek, kaynak koduna dönüştürmek veya değiştirmek
- İçeriği izinsiz çoğaltmak, dağıtmak veya ticari olarak sunmak
- Uygulamayı yasa dışı bir amaçla ya da başkalarına zarar verecek şekilde kullanmak
- Sunucularımıza otomatik, aşırı veya hizmeti bozacak nitelikte istek göndermek
7. Ücretli özellikler
Uygulamanın temel işlevleri ücretsizdir. Bazı özellikler ileride ücretli bir plan
kapsamında sunulabilir. Ücretli özellikler devreye girdiğinde:
- Satın alma ve yenilemeler Google Play üzerinden yapılır; ödeme bilgilerinize erişimimiz olmaz.
- Abonelikler, siz iptal etmediğiniz sürece dönem sonunda otomatik yenilenir. İptal, Google Play hesap ayarlarından yapılır.
- İade talepleri Google Play'in iade politikasına tabidir.
- AB'de yerleşik tüketiciler, dijital içerik için 14 günlük cayma hakkına sahiptir; içeriğin hemen kullanılmaya başlanması hâlinde bu hakkın kapsamı mevzuata göre sınırlanabilir.
- Fiyat değişiklikleri yürürlüğe girmeden önce bildirilir ve mevcut dönemi etkilemez.
8. Fikri mülkiyet
Uygulamanın kendisi, arayüzü, metinleri, öneri mantığı ve görselleri Oasis of Balance'a aittir
ve telif hakkı ile korunur. Uygulamayı kişisel, ticari olmayan amaçla kullanmanız için
devredilemez ve münhasır olmayan bir kullanım hakkı verilir. Kendi girdiğiniz veriler
size aittir.
9. Garanti ve sorumluluk
Uygulama "olduğu gibi" sunulur. Kesintisiz veya hatasız çalışacağı garanti edilmez.
Uygulamanın önerilerine dayanarak aldığınız kararların sorumluluğu size aittir.
Yürürlükteki hukukun izin verdiği azami ölçüde, uygulamanın kullanımından doğan dolaylı
zararlardan, veri kaybından veya kâr kaybından sorumlu değiliz.
Bu sınırlama; kasıt, ağır ihmal ile ölüm veya bedensel zarar hâllerinde ve
tüketici mevzuatının tanıdığı hakların sınırlanamayacağı hâllerde uygulanmaz.
10. Hizmetin değişmesi veya sona ermesi
Uygulamayı geliştirebilir, özellik ekleyebilir veya kaldırabiliriz. Hizmeti tamamen
sonlandırmamız hâlinde, verilerinizi dışa aktarabilmeniz için makul bir süre önceden
uygulama içinde bildirim yaparız.
11. Şartlardaki değişiklikler
Bu şartlar değişirse güncel sürüm bu sayfada yayınlanır ve üstteki tarih güncellenir.
Esaslı değişikliklerde uygulama içinde bilgilendirme yapılır. Değişiklikten sonra
uygulamayı kullanmaya devam etmeniz yeni şartları kabul ettiğiniz anlamına gelir.
12. Uygulanacak hukuk
Bu şartlara İspanya hukuku uygulanır. Tüketici sıfatıyla, yerleşik olduğunuz ülkenin
tüketici mevzuatının size tanıdığı emredici haklar saklıdır ve kendi ülkenizin
mahkemelerine başvurabilirsiniz.

In short: SmartPlate is an educational and habit-building tool designed to make
everyday meal decisions easier. It is not a medical device, it does not diagnose,
it does not prescribe treatment, and it does not replace your doctor.
1. Scope
These terms govern your use of the SmartPlate mobile app and the pages on
oasisofbalance.com. By installing or using the app
you accept these terms. If you do not accept them, please do not use the app and remove it from
your device.
The app is provided by Oasis of Balance.

2. What the app does
- Suggests a general framework for building your meals, based on the information you enter.
- Lets you keep meal, water and daily records.
- Reflects weekly and monthly patterns from your own records back to you.
- Does not rely on calorie counting; it focuses on portion and composition decisions.
3. What the app does not do — important health notice
SmartPlate is not a medical device. It does not diagnose, treat, monitor or
prevent any disease. Nothing in the app constitutes medical advice, diagnosis or
treatment.
The information in the app is general in nature and based on the general adult
population. Only a health professional who examines you can assess whether it is appropriate
for your individual situation.
You should especially consult a health professional before using the app if you:
- are pregnant or breastfeeding
- have diabetes, kidney, liver or heart disease
- have a history of an eating disorder
- take medication that interacts with nutrition (including insulin, oral antidiabetics, anticoagulants, thyroid medication)
- are under 18
Do not use the app in a health emergency; call your local emergency number
(112 across the EU).
4. Who may use it
The app is intended for people aged 16 and over. If you are under 18 you should
use it only with the knowledge and consent of a parent or guardian.
5. Accounts and your data
- The app works without an account; it does not ask for your name, email or phone number.
- All of your health-related data is stored on your device only. We operate no cloud backup and cannot see this data.
- Because of this, if you delete the app, change phone or lose your device, your records cannot be recovered.
- Keeping your device and the account it is installed under secure is your responsibility.
How data is processed is explained in the Privacy Policy.
6. Unacceptable use
- Reverse-engineering, decompiling or modifying the app
- Copying, redistributing or commercially exploiting the content without permission
- Using the app for unlawful purposes or in a way that harms others
- Sending automated, excessive or disruptive requests to our servers
7. Paid features
The core functionality is free. Some features may later be offered under a paid plan. When paid
features are introduced:
- Purchases and renewals are handled by Google Play; we have no access to your payment details.
- Subscriptions renew automatically at the end of each period unless you cancel. Cancellation is done in your Google Play account settings.
- Refund requests are subject to Google Play's refund policy.
- Consumers resident in the EU have a 14-day right of withdrawal for digital content; where the content is made available immediately, the scope of that right may be limited under applicable law.
- Price changes are announced before they take effect and do not affect the current period.
8. Intellectual property
The app itself, its interface, texts, guidance logic and visuals belong to Oasis of Balance and
are protected by copyright. You are granted a non-exclusive, non-transferable right to use the
app for personal, non-commercial purposes. The data you enter belongs to you.
9. Warranty and liability
The app is provided "as is". We do not guarantee that it will run uninterrupted or error-free.
You are responsible for the decisions you make based on the app's suggestions.
To the maximum extent permitted by applicable law, we are not liable for indirect damages, data
loss or loss of profit arising from use of the app.
This limitation does not apply in cases of intent or gross negligence, in cases of death
or personal injury, or where consumer law does not permit such limitation.
10. Changes to or discontinuation of the service
We may develop the app and add or remove features. If we discontinue the service entirely, we
will give reasonable advance notice in the app so that you can export your data.
11. Changes to these terms
If these terms change, the current version will be published on this page and the date above
updated. Material changes will be announced in the app. Continuing to use the app after a change
means you accept the new terms.
12. Governing law
These terms are governed by Spanish law. As a consumer, the mandatory rights granted to you by
the consumer law of your country of residence remain unaffected, and you may bring proceedings
before the courts of your own country.
